Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the LuxLinx mobile application and website (collectively, the “Service”) operated by LuxLinx (“we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use LuxLinx. By using the Service, you represent that you meet these requirements.

2. Account Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and to update it as needed. Notify us immediately of unauthorized use of your account.

3. Membership and Subscriptions

LuxLinx may offer free and paid membership features, including messaging access and Gold Host membership. Paid subscriptions are billed through Stripe on a recurring basis unless canceled. Prices and features are displayed in the app and may change with notice where required by law.

• Subscription fees are charged to the payment method you provide through Stripe.
• You may cancel subscriptions according to instructions provided at checkout or by contacting support.
• Except where required by law, fees are non-refundable once a billing period has started.
• We may modify, suspend, or discontinue membership tiers or features at any time.

4. Host and Join Experiences

Members with appropriate membership may publish hosted experiences and request to join experiences published by others. LuxLinx is a platform that facilitates discovery and communication; we do not operate venues, provide transportation, or guarantee the safety, quality, or legality of any third-party event.

• Hosts are solely responsible for their events, guest approvals, cancellations, pricing, and compliance with applicable laws.
• Guests participate at their own risk and should exercise independent judgment before attending any experience.
• LuxLinx is not a party to agreements between members and is not responsible for disputes, injuries, losses, or damages arising from offline interactions.

5. Acceptable Use

You agree not to:

• Use the Service for unlawful, fraudulent, harassing, abusive, or discriminatory purposes;
• Post false, misleading, or impersonating content;
• Share content that is obscene, threatening, or infringes others’ rights;
• Scrape, reverse engineer, or attempt unauthorized access to the Service or other users’ accounts;
• Use the Service to spam, solicit, or advertise without permission;
• Circumvent membership limits, payment systems, or security features.

We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to the community.

6. User Content

You retain ownership of content you submit. By posting content on LuxLinx, you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute that content solely to operate and improve the Service. You represent that you have the rights to post your content and that it does not violate any law or third-party rights.

7. Privacy

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

8. Intellectual Property

The Service, including the LuxLinx name, logo, design, and software, is owned by LuxLinx or its licensors and is protected by intellectual property laws. You may not copy, modify, or distribute our materials without prior written consent.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUXLINX AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR ANY OFFLINE EXPERIENCE OR INTERACTION WITH OTHER MEMBERS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

11. Indemnification

You agree to indemnify and hold harmless LuxLinx from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your content, your hosted experiences, or your violation of these Terms or applicable law.

12. Termination

You may stop using the Service at any time. We may suspend or terminate your access at any time, with or without notice, for conduct that we believe violates these Terms or harms the Service or other users.

13. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law principles. You agree that exclusive jurisdiction for disputes arising from these Terms or the Service shall be in the state or federal courts located in Texas, unless otherwise required by applicable law.

14. Changes to Terms

We may update these Terms from time to time. We will post the updated Terms on this page and update the “Last updated” date. Continued use after changes constitutes acceptance.
